Terms of Service

Welcome to Buy It Built. These Terms of Service (“Terms”) govern your access to and use of the Buy It Built website, apps, and services (collectively, the “Service”), operated by Buy It Built USA LLC (“Buy It Built,” “we,” “us,” or “our”). By creating an account, posting a listing, or otherwise using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.

1. What Buy It Built Is (and Isn’t)

Buy It Built is an online marketplace and advertising platform that lets people list vehicles for sale and lets interested buyers contact sellers. We are not a party to any transaction between buyers and sellers. We do not own, inspect, store, deliver, broker, or sell any vehicle listed on the Service, and we are not a dealer, broker, auctioneer, or agent for any user. All sales are directly between the buyer and the seller. We do not guarantee the existence, quality, safety, legality, or accuracy of any listing, or that a buyer or seller will complete a transaction.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that all information you provide is accurate.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate, current information and keep it updated. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Listings and Seller Responsibilities

If you post a listing, you represent and agree that:

  • You own the vehicle or are authorized to sell it, and you have the legal right to transfer title.
  • Your listing is accurate, truthful, and not misleading, including condition, mileage, title status, modifications, and any money owed on the vehicle.
  • The vehicle is not stolen, and the sale does not violate any law or third-party rights.
  • You are solely responsible for your listing, your communications, and completing any sale, including title transfer, taxes, and compliance with applicable laws.

5. Buyer Responsibilities

Buyers are responsible for their own due diligence. Inspect the vehicle, verify the title and VIN, confirm condition, and satisfy yourself before buying. Transactions, payments for vehicles, and any disputes are solely between you and the seller. Buy It Built is not responsible for the acts or omissions of any user.

6. Fees and Payments

Sellers pay a listing fee to publish a listing for a set duration. Buyers pay a fee to unlock messaging with a seller. All fees are displayed before purchase and processed by our third-party payment provider, Stripe. By paying, you authorize the charge. Except as stated in our Refund Policy, all fees are non-refundable. We may change our fees or plans at any time; changes apply to future purchases.

7. Prohibited Conduct

You agree not to:

  • Post false, fraudulent, stolen, or illegal listings, or content you don’t have the right to post.
  • Harass, threaten, defraud, or spam other users.
  • Circumvent, disable, or interfere with the Service or its fees, including attempting to avoid payment.
  • Scrape, copy, or harvest data from the Service without permission.
  • Use the Service for any unlawful purpose or in violation of these Terms.

8. Your Content

You retain ownership of the content you post (photos, descriptions, messages). By posting, you grant Buy It Built a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content to operate and promote the Service. You are responsible for your content and confirm you have the rights to it.

9. No Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any listing, user, or transaction is legitimate, accurate, or will result in a completed sale. You use the Service at your own risk.

10. Assumption of Risk and Limitation of Liability

You understand that buying and selling vehicles involves risk, and you assume that risk. To the fullest extent permitted by law, Buy It Built and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of any transaction, listing, or interaction between users. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $100.

11. Indemnification

You agree to indemnify and hold harmless Buy It Built from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your listings or content, your transactions, or your violation of these Terms or any law.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service and delete your account at any time.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Tennessee, and you consent to their jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we’ll update the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
